The online store available at www.byrieske.com is operated by Monika Rieske, conducting business under the name BY RIESKE Monika Rieske, hereinafter referred to as the “Seller”.
These Terms and Conditions define the rules for using the Store, placing Orders, concluding sales contracts, Order fulfilment, as well as the rights and obligations of Customers and the Seller.
The Store conducts retail sales of clothing and accessories under the By Rieske brand, in particular limited-edition Products manufactured in short series or made to order.
The Terms and Conditions are made available to the Customer free of charge prior to the conclusion of the contract in a manner that enables their storage, reproduction and retrieval.
Contracts concluded via the Store are governed by Polish law, in particular the Polish Civil Code and the Act on Consumer Rights.
The Seller may be contacted electronically, in particular via the contact form available on the Store’s website.
§2. Definitions
Store – the online store operated at www.byrieske.com
Seller – BY RIESKE Monika Rieske
Customer – any entity placing an Order in the Store
Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity
Product – goods offered for sale in the Store
Order – a declaration of intent by the Customer aimed at concluding a sales contract
Sales contract – a contract concluded between the Customer and the Seller via the Store
Business day – a day from Monday to Friday, excluding public holidays
§3. Use of the Store and conclusion of the contract
Using the Store requires a device with internet access, an up-to-date web browser and an active email address.
Information about Products displayed in the Store constitutes an invitation to enter into a contract within the meaning of the Polish Civil Code.
Due to handmade finishes, natural material characteristics and short production runs, slight differences between Product images and the actual Product may occur and do not constitute a defect.
A sales contract is concluded at the moment the Seller confirms the Order electronically.
The Store fulfils Orders in accordance with the options available during the purchasing process.
§4. Placing Orders
Orders may be placed 24 hours a day, 7 days a week via the Store’s website.
Placing an Order consists of selecting a Product, adding it to the shopping cart, completing the required details, choosing a delivery and payment method, and confirming the Order.
Placing an Order constitutes an offer to conclude a sales contract.
Automatic confirmation of Order receipt does not constitute the conclusion of a sales contract.
§5. Prices and payment methods
Prices displayed in the Store are gross prices and are shown in the selected currency (PLN, EUR, GBP or USD), where applicable in accordance with tax regulations.
The Product price applicable at the time of placing the Order shall apply.
Delivery costs are indicated during the Order placement process.
Available payment methods include:
a) electronic payments processed via payment operators available during checkout (PayPal or Przelewy24, depending on the language version of the Store), in accordance with the payment options offered by the selected operator,
b) standard bank transfer – as a prepayment to the Seller’s bank account.
Detailed information regarding payments and bank account numbers is available in a separate “Payment” section of the Store.
§6. Order fulfilment and delivery
Order fulfilment begins after the conclusion of the sales contract and receipt of payment, where payment is required.
The fulfilment time depends on the nature of the Product and is indicated in the Store or during the Order placement process.
Delivery is carried out via DPD courier services, in accordance with the options available during checkout, or by personal collection at the Seller’s studio by prior arrangement.
The Seller shall not be liable for delays resulting from causes attributable to the carrier.
§7. Right of withdrawal (returns)
A Consumer has the right to withdraw from the contract within 14 days from the date of receipt of the Product, without providing any reason.
The declaration of withdrawal should be submitted electronically or in writing.
Returned Products must be unused, free from signs of wear, washing or odours, and returned in an unchanged condition, except for what is necessary to establish the nature, characteristics and functioning of the Product.
The cost of returning the Product shall be borne by the Consumer.
The refund shall be made no later than 14 days from the date the Seller receives the declaration of withdrawal; however, the Seller may withhold the refund until the returned Product is received.
The refund shall be issued after inspection of the Product.
The right of withdrawal does not apply to personalised Products or Products manufactured to the Customer’s individual specifications, in accordance with Article 38(3) of the Polish Act on Consumer Rights.
§8. Made-to-order and personalised Products
At the individual request of the Customer, the Seller may offer the production of a Product made to order or in a non-standard size, subject to the availability of materials.
For personalised Products, an advance payment of 30% of the Product price is required prior to the commencement of production.
If the Customer withdraws from the execution of an Order for a personalised Product after production has commenced, the paid advance of 30% of the Product price shall not be refundable, as it constitutes security for costs incurred by the Seller in connection with the commencement of the individual Order.
The remaining part of the price shall be paid prior to shipment of the Product.
Personalised Products are not subject to return or withdrawal from the contract, in accordance with Article 38(3) of the Polish Act on Consumer Rights.
The Customer is informed of the terms and conditions of personalisation prior to the commencement of Order processing.
§9. Complaints
The Seller is liable for defects in the Product in accordance with applicable law.
Complaints should be submitted electronically or in writing, describing the defect and the circumstances of its occurrence.
Complaints are reviewed within 14 days from the date of receipt.
The Seller shall not be liable for minor differences resulting from handmade production, natural material characteristics or individual monitor settings.
§10. Personal data
The Seller is the controller of Customers’ personal data.
Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
Detailed information regarding the processing of personal data is available in the Privacy Policy published on the Store’s website.
§11. Final provisions
These Terms and Conditions are effective from the date of their publication on the Store’s website.
The Seller reserves the right to amend the Terms and Conditions while respecting the rights acquired by Customers.
Matters not regulated herein shall be governed by Polish law.
